DUI

Edmond, Oklahoma, DUI Lawyer

There are ways to win a DUI case. Too many people arrested for DUI simply pay their fine and consider the matter done. If you were stopped for drunk driving, it is important, whether you are charged with a 1st offense or have a previous conviction, that you take proactive measures to see that your get the best possible outcome.

Before paying a fine or talking to the prosecutor, contact Jencks Law Firm in Edmond to arrange a free consultation about your DUI.

As your attorney, I will explain exactly what options are available under the law and the likely outcome of each. You decide how to proceed. It is my goal to keep you out of jail and see that your driving privileges are reinstated as soon as possible. I may be able to get charges against you dismissed, negotiate a plea bargain to a lesser offense or take your case to trial.

DUI defense strategies

I challenge the evidence and make the state prove its case. I will examine the record of your arrest and all evidence being used against you. Did the police follow proper procedures when administering a roadside sobriety test or blood or breath test? Was the equipment properly calibrated? Did the analysis of the BAC test take any special conditions into account? Should the blood or urine sample be sent to an independent lab? Particularly in a first-offense DUI case, I have a good shot at helping you avoid conviction. If you were charged with a second or later offense, or felony DUI, I will work to have you charged at a lower level.

Getting your driver's license back

In Oklahoma, you have 15 days after a DUI or DWI arrest to request a hearing with the Department of Public Safety. If you fail to do so, the DPS automatically suspends your license for six months for a first offense arrest. At that hearing your attorney can request a variety of options, including an Intoxilyzer in your car, that car that will allow you limited driving privileges.

Public intoxication

Your car is one of the least private places. You can be a passenger, seated next to your designated driver, and still be charged with public intoxication if the police stop the car. I provide defense for charges of public intoxication.
