Protective Orders

Oklahoma City Lawyer: Protective Orders

Most couples argue. When a disagreement between husband and wife, boyfriend and girlfriend, or parent and child escalates to the point that one person feels threatened, Oklahoma law considers the action domestic abuse. The court has the power to issue an emergency protective order (sometimes referred to as a temporary restraining order) that prevents the alleged abuser from contact with adults or children in the home, or might require the person named in the order to stay away from the home altogether.

A judge can issue an emergency ex parte protection order based simply on an accusation of assault and battery, stalking, harassment or rape. The person named as the abuser has the right to a hearing within a few days. At the hearing the judge will listen to all evidence and testimony. The hearing might result in a final protection order, which can last for up to three years, or dismiss the matter.

The family law judge has extensive experience in these matters, realizes a person involved in a divorce or custody dispute might exaggerate or bring false charges, and is charged with protection of vulnerable family members from further assaults. It is extremely important that you work with an experienced family law attorney when preparing for your hearing, so that your case is as strong as possible.

  • If you believe you or your child is in danger of a violent or sexual assault by a member of your household, you should take immediate steps to get a restraining order. Your attorney will explain exactly what protection is available to you and what to do next.
  • If a protection order named you as an abuser, it is important to take immediate measures to see that your rights are protected during your hearing. The consequences of a domestic violence conviction on your permanent record are serious, and any violation of a protection order can mean jail time.
